Introduction

This document sets out all fees and charges that Redbridge Property may charge to tenants under the Tenant Fees Act 2019. We are committed to transparency and will always provide a clear breakdown of any charges before a tenancy begins or any changes are made.

Important Legal Notice: Under the Tenant Fees Act 2019, certain charges to tenants are prohibited and will be refunded immediately if charged. This page explains what we can and cannot charge.

PERMITTED CHARGES TO TENANTS

Under the Tenant Fees Act 2019, tenants can only be charged for the following fees:

1. Rent

Rent is the only charge that is not limited or restricted. You are responsible for paying rent in full by the agreed date each month.

2. Deposit

Deposit Protection (Your Rights):

  • Your deposit must be held in a government-authorized scheme
  • You will receive prescribed information within 30 days
  • The deposit can only be used for legitimate deductions
  • You can dispute deductions through the scheme
  • The full amount must be returned if no deductions are made

3. Holding Deposit

About Holding Deposit:

  • Paid when you wish to reserve a property
  • Held while we carry out referencing (usually 15 days)
  • Refunded if your application is rejected
  • Deducted from your security deposit if your application is approved
  • Non-refundable if you withdraw your application

4. Changes to Tenancy Terms

What This Covers:

  • Changes made at tenant request (new occupants, term extension)
  • Preparation of new agreement documents

  • If costs exceed £50, we will charge actual costs with evidence

5. Late Rent Payment

Important: Late payment charges can only be charged when rent is more than 14 days overdue. Payment must first be requested before the charge is applied. This charge is to cover administrative costs of chasing overdue rent.

6. Lost Key or Security Device Replacement

About Lost Key Charges:

  • Only charged if you lose keys/security devices
  • Covers cost of replacement key/device and lock changes if required
  • Must be reported immediately to avoid security issues
  • Charge is deducted from your deposit or invoiced separately
  • You are responsible for looking after all provided keys and devices

7. Early Termination Fee

Early Termination Details:

  • Only charged if you request early exit from a fixed-term tenancy
  • Exact amount specified in your individual lease agreement
  • Usually covers landlord’s costs of finding new tenant
  • Cannot exceed actual losses suffered by landlord
  • You must provide notice as specified in your lease

PROHIBITED CHARGES

The following charges are ILLEGAL under the Tenant Fees Act 2019. We will NEVER charge tenants for:

Tenancy Documentation Fee Preparing lease is landlord/agent responsibility
Right to Rent Check Fee Mandatory legal check, landlord must do this
AST Check Fee Preparing assured shorthold tenancy is landlord duty
Complaint/Disputes Fee Handling complaints is part of service

IF YOU ARE CHARGED ANY OF THESE:

You have the right to request an immediate refund. If we do not refund within 14 days, you can report us to your local council Trading Standards or pursue a claim in court for up to 3 times the unlawful fee charged.

DEPOSIT DEDUCTIONS AT END OF TENANCY

Your deposit can only be deducted for legitimate reasons. Permitted deductions include:

  • Unpaid rent
  • Damage beyond normal wear and tear
  • Cleaning costs (if property left dirty)
  • Missing or broken items provided
  • Breaches of tenancy agreement

FREQUENTLY ASKED QUESTIONS

Q: Why am I being charged a holding deposit?

A: The holding deposit reserves the property for you while we carry out referencing checks (usually 15 days). This protects both you and us. It’s refunded if your application is rejected or deducted from your deposit if approved.

Q: Can you charge me for checking my references?

A: No. Checking your references is our cost and responsibility as a letting agent. You cannot be charged for this.

Q: What if I lose my keys?

A: If you lose your keys, we will charge you £175 to cover replacement costs and any necessary lock changes. This is a permitted charge under tenant law. The charge can be deducted from your deposit or invoiced separately.

Q: Can you charge me if I pay rent late?

A: Only if rent is more than 14 days late, we will charge £35 as a one-time charge. We must first request payment before charging this fee.

Q: What happens if I want to add a housemate?

A: If you wish to add an occupant or change tenancy terms, we can charge £50 or actual costs (whichever is higher) to cover preparation of new documentation and administrative processing.

Q: How much can my deposit be?

A: Your deposit cannot exceed 5 weeks’ rent. If the rent is £500/week, your deposit maximum is £2,500. Your holding deposit (1 week) is usually deducted from this 5-week amount.

Q: What if I’m charged an illegal fee?

A: Contact us immediately at 020 8590 2277 or info@redbridgeproperty.uk. We will refund the charge within 14 days. If we don’t, you can report us to Trading Standards or take legal action for up to 3 times the illegal fee charged.
